Canada Spouse Visa Requirements

You can sponsor your spouse, partner or dependent child if:

  • You’re at least 18 years old
  • You’re a Canadian citizen, a permanent resident of Canada, or a person registered in Canada as an Indian under the Canadian Indian Act
    • If you’re a Canadian citizen living outside Canada, you must show that you plan to live in Canada when the persons you want to sponsor become permanent residents.
    • You can’t sponsor someone if you’re a permanent resident living outside Canada.
  • You’re able to prove that you’re not receiving social assistance for reasons other than a disability
  • you can provide for the basic needs of any persons you want to sponsor.

If you live outside Quebec

To become a sponsor, you must promise to financially take care of the persons you are sponsoring for a period of time. We call this promise an undertaking.

The undertaking commits you to:

  • providing financial support for your sponsored family members, starting when they become permanent residents
  • repaying any provincial social assistance your sponsored family members get during that time.

If you live in Quebec

You must meet Quebec’s immigration sponsorship requirements after we approve you as a sponsor. You must sign an undertaking with the province of Quebec.

The Quebec ministry in charge of immigration will assess your income.

Canada Spouse Open Work Permit:

You may be eligible for an open work permit if you’re:

  • a spouse of a skilled worker in an occupation under the National Occupational Classification (NOC) skill type 0, A or B approved to work in Canada six months or longer
  • a spouse of someone applying for the Atlantic Immigration Pilot Program in a job under NOC 0, A, B or C
  • a spouse of a foreign student at a public post-secondary school, such as a college or university or collège d’enseignement général et professionnel (CEGEP) in Quebec

Document Checklist for Spouse Open work permit

A foreign worker applicant must gather all the required documents for Canadian Temporary Work Permit above from his/her employer as well as the following documents and forms:

  • A valid travel document or passport
  • Two photos of yourself and photos of accompanying family members
  • Evidence that you meet the requirements for your prospective job
  • Certificat D’Acceptation du Quebec, if required. (The Quebec LMIA Application Process and Extensions to Quebec Work Permits.)
  • Proof of relationships with all spouses, children or common-law partners
  • Completed Application For Work Permit Made Outside of Canada (IMM 1295) form, if applying from outside of Canada
  • Completed Document Checklist (IMM 5488)
  • Completed Family Information (IMM 5645) form
  • Completed Schedule 1 – Application for Temporary Resident Visa form. This form must be completed by: the principal applicant, his/her spouse or common-law partner and all dependant children older than 18. This form must only be completed by foreign nationals who require a temporary resident visa to enter Canada.   • Completed Statutory Declaration of Common-law Union (IMM 5409) form Completed Use of a Representative (IMM 5476) form. Note: You must only complete this form if a representative will be conducting business on your behalf. All dependant children older than 18 who are using a representative must also complete this form.
